Yaa-Naa Case Not Closed – Alban Bagbin

Majority Leader, Alban Bagbin has disagreed with a nominee for the Supreme Court, Justice Yaw Apau that the Yaa-Naa case was closed.

Mr. Bagbin said the committee set up to investigate the matter recommended that further investigation be conducted for criminal prosecution; hence, there was opportunity for people to be prosecuted.

The Majority Leader said these yesterday while contributing the motion recommending the approval of the two Supreme Court nominees.

He also disagreed with Justice Apau that the conflict was a “war” and explained that it was only the President of the Ghana who could declare war in any part of the country.

“What happened in Yendi could not be described as a war but a feud” between the Abudus and Andanis, Mr. Bagbin stated.

Justice Apau, during his vetting for the Supreme Court stated that the case involving the trial of accused persons in the murder of the Ya-Na, Dagbon Overlord has come to a logical conclusion based on the facts presented to him.

Justice Apau noted that according to the facts presented to him at the time of hearing and ruling on the matter, the accused persons could not be proven guilty of the charges leveled against them.

He, however, noted that if there are suppressed facts about the matter, the case could be recalled for further interrogation.

Justice Apau, who was also the Sole Commissioner for the Judgment Debt Commission constituted by the President, further explained that according to the facts presented to him, it was a 3-day war that led to the killing of the Dagbon Overlord.

He said the media also hyped the war and made some inaccurate reportage that affected the conflict.

Presenting the Appointment Committee’s report, Chairman of the Committee, Ebo Barton Oduro said the two nominees, Justice Apau and Gabriel Pwamang were qualified for the positions they were being nominated for.

Both sides of the House also expressed confidence in the competence of the nominees and unanimously approved them.
